The number of elderly in our population continues to increase, so does the number of nursing home and assited living facilities. While long term care facilities play a necessary role in our society, they are businesses. The industry has been plagued by mismanagement, corruption and fraud. Federal and State governments, however, have passed laws to insure that nursing home residents receive the care, treatment and quality of life to which they are entitled. How do you know when a nursing home is violating the rights of a resident in its care? While laws regulating the standard of care may vary state to state, almost every state recognizes certain injuries to be indications of negligence, violating the rights of and causing harm to the resident.
